HB0066-Judicial Deference-Agencies

***LAC is the Legislative Action Committee of the RWSC (Republican Women of Sheridan County).  Below is the main message showing our position and reasons why we support or oppose a bill.   

We support HB0066, Judicial Deference - agencies, for the following reasons:

· This bill amends the process and standards of judicial review of actions taken by a governmental agency pursuant to a state statute or regulation. 

· It establishes that the reviewing court shall not defer to a state agency’s interpretation of the statute, rule, regulation or final decision. The court must make its own, independent review.

· This bill establishes (by repeal) that rules adopted by the supreme court may not supersede existing statutes and that the reviewing court shall not consider prejudicial error when reviewing the agency’s actions.

· It establishes that the court shall exercise any remaining doubt in favor of a reasonable interpretation that limits agency power and maximizes individual liberty.

· This bill is supported by the Wyoming GOP Platform protecting individual liberty and limiting the power of government.
